AB 5447 Progresses to the Consumer Affairs Committee

Assemblyman Clinton Calabrese, the primary sponsor of the bill, initially intended to regulate sweepstakes casinos when he introduced legislation in January. However, by March, the focus shifted towards a complete prohibition of such platforms.
Penalties for Operators
The full text of AB 5447 now clearly defines sweepstakes platforms as illegal, proposing substantial penalties for operators found in violation of the law. Assemblyman Calabrese and co-sponsor Assemblyman Sterley Stanley have provided a detailed explanation of what constitutes a sweepstakes model.
The bill defines sweepstakes as “a promotional, advertising, or marketing event, contest, or game where a prize or prize equivalent is awarded through means like a dual currency system of payment.”
Under the proposed legislation, platforms allowing players to purchase virtual currency for prizes, even without direct gambling, will be prohibited. Enforcement of the law would be the responsibility of the Division of Consumer Affairs and the Division of Gaming Enforcement (DGE).
Fines and Exceptions
Violators could face fines of up to $100,000 for a first offense and up to $250,000 for a second offense, with legal action being a possibility. However, there is a limited exception for physical sweepstakes that are entirely free to play or tied to small food or beverage purchases.
