Underdog Fantasy, a Daily Fantasy Sports (DFS) operator, has reached a $17.5 million settlement with the New York State Gaming Commission (NYSGC) following allegations of unlawful operations. The company has agreed to withdraw its drafts and pick’em games from the state market after cooperating with the investigation.
The Investigation and Settlement
The settlement was announced on Friday after an NYSGC investigation revealed that Underdog utilized its subsidiary, Synkt, to offer DFS contests that were not allowed under New York law. Despite denying any wrongdoing, the company decided to settle and pay the fine to avoid a lengthy legal battle.
NYSGC Commission chair, Brian O’Dwyer, emphasized the importance of playing through permitted or registered operators to ensure compliance with regulations that protect New Yorkers.

Underdog defended its position by highlighting the regulatory uncertainties surrounding New York’s DFS industry for almost a decade. The company’s general counsel, Nicholas Green, clarified that the issue was related to licensing rules rather than specific game offerings. Despite the setback, Underdog remains committed to returning to New York and has applied for a permanent license.
Green expressed optimism about resuming operations in New York and working closely with the commission to achieve this goal.
Expansion Plans and Compliance
Although Underdog has temporarily withdrawn from New York, it has already laid the groundwork for its return by applying for a permanent fantasy sports license. By cooperating with the state regulator, the company hopes to receive approval to resume operations in one of its key markets.
Amidst regulatory challenges in New York, Underdog is focusing on expanding its presence in other states. The company is set to introduce its Pick’em Champions product in New Jersey and Delaware, aligning with its strategy to grow while adhering to local regulations.
Underdog has also adapted its business model in various states to comply with different regulatory frameworks. In 16 states, the company offers peer-to-peer games under the Champions brand, catering to the evolving regulatory landscape in the US.
